L&#039;organisme \u00e9labore des recommandations, \u00e9galement connues sous le nom de normes du GAFI, pour coordonner une r\u00e9ponse uniforme \u00e0 la lutte contre le crime organis\u00e9.<\/p>\n<p>La Pl\u00e9ni\u00e8re est <a href=\"https:\/\/www.fatf-gafi.org\/about\/whoweare\/\" target=\"_blank\" rel=\"nofollow noopener\">du GAFI<\/a> fonction de d\u00e9cision et il se r\u00e9unit trois fois par an. La plus r\u00e9cente de ces r\u00e9unions a eu lieu en juin 2021. Elle \u00e9tait dirig\u00e9e par le pr\u00e9sident allemand, le Dr Marcus Pleyer, avec plus de 205 membres pr\u00e9sents dans le monde.<\/p>\n<p>La r\u00e9union s&#039;est tenue virtuellement et a r\u00e9uni des organismes de surveillance du blanchiment d&#039;argent, le <a href=\"https:\/\/www.un.org\/en\/\" target=\"_blank\" rel=\"nofollow noopener\">ONU<\/a>, la <a href=\"https:\/\/www.imf.org\/en\/Home\" target=\"_blank\" rel=\"nofollow noopener\">FMI<\/a>, et le <a href=\"https:\/\/www.worldbank.org\/en\/home\" target=\"_blank\" rel=\"nofollow noopener\">Banque mondiale<\/a>.<\/p>\n<p>Cet article traite des initiatives strat\u00e9giques qui d\u00e9couleront de cette r\u00e9union.<\/p>\n<h2 id=\"digital-transformation-amlcft\">Transformation num\u00e9rique &amp; LBC\/FT<\/h2>\n<p>L&#039;un des principaux sujets de discussion lors de la pl\u00e9ni\u00e8re \u00e9tait de savoir comment les progr\u00e8s technologiques offrent une opportunit\u00e9 d&#039;am\u00e9liorer l&#039;efficacit\u00e9 de la LBC et du CFT.<\/p>\n<p>La transformation num\u00e9rique a permis de cr\u00e9er plus facilement et plus rapidement des syst\u00e8mes d&#039;aide \u00e0 la lutte contre le blanchiment d&#039;argent et le financement du terrorisme. La technologie aide les institutions financi\u00e8res telles que les banques \u00e0 identifier et \u00e0 \u00e9valuer les risques d&#039;une mani\u00e8re \u00e0 la fois pr\u00e9cise et rapide.<\/p>\n<p>Le GAFI a identifi\u00e9 comment l&#039;utilisation des outils de mise en commun des donn\u00e9es et d&#039;analyse collaborative aide ces institutions \u00e0 changer leur fa\u00e7on d&#039;analyser de grandes quantit\u00e9s de donn\u00e9es. Cela signifie qu&#039;ils peuvent analyser un nombre \u00e9lev\u00e9 de transactions et identifier les comportements suspects. En outre, les nouvelles technologies contribuent \u00e9galement \u00e0 l&#039;inclusion financi\u00e8re en attirant davantage de personnes dans le syst\u00e8me financier r\u00e9glement\u00e9.<\/p>\n<p><a href=\"http:\/\/www.fatf-gafi.org\/publications\/digitaltransformation\/documents\/opportunities-challenges-new-technologies-for-aml-cft.html?hf=10&amp;b=0&amp;s=desc(fatf_releasedate)\" target=\"_blank\" rel=\"nofollow noopener\">Ce rapport<\/a> discute des technologies disponibles, des politiques n\u00e9cessaires pour les utiliser efficacement et des obstacles qui se dressent sur la voie du succ\u00e8s.<\/p>\n<h2 id=\"the-risks-associated-with-virtual-assets\">Les risques associ\u00e9s aux actifs virtuels<\/h2>\n<p>Juin 2021 a vu la fin du deuxi\u00e8me examen de 12 mois de la mise en \u0153uvre du GAFI <a href=\"http:\/\/www.fatf-gafi.org\/media\/fatf\/documents\/recommendations\/Second-12-Month-Review-Revised-FATF-Standards-Virtual-Assets-VASPS.pdf\" target=\"_blank\" rel=\"nofollow noopener\">Normes r\u00e9vis\u00e9es sur les actifs virtuels<\/a> et les fournisseurs de services d&#039;actifs virtuels (\u00ab\u00a0VASP\u00a0\u00bb).<\/p>\n<p><strong>Progr\u00e8s r\u00e9alis\u00e9s<\/strong><\/p>\n<p>Le GAFI a constat\u00e9 que de nombreuses juridictions ont bien progress\u00e9 depuis 2019 \u2013 58 des 128 juridictions d\u00e9clarantes ont d\u00e9sormais mis en \u0153uvre les normes r\u00e9vis\u00e9es. 52 r\u00e9glementent d\u00e9sormais les op\u00e9rations des VASP et 6 interdisent compl\u00e8tement le fonctionnement des fournisseurs de crypto-monnaie.<\/p>\n<p><strong>Un \u00e9chec dans la mise en \u0153uvre de la \u00ab\u00a0r\u00e8gle du voyage\u00a0\u00bb<\/strong><\/p>\n<p>La plupart des juridictions n&#039;ont pas encore mis en \u0153uvre la \u00abr\u00e8gle de voyage\u00bb, entre autres exigences du GAFI, et, \u00e0 ce titre, il reste encore beaucoup \u00e0 faire. La r\u00e8gle de voyage est le nom commun pour <a href=\"http:\/\/www.fatf-gafi.org\/media\/fatf\/documents\/recommendations\/pdfs\/FATF%20Recommendations%202012.pdf\" target=\"_blank\" rel=\"nofollow noopener\">Recommandation du GAFI #16<\/a> sur la lutte contre le blanchiment d&#039;argent. Il oblige les parties \u00e0 une transaction num\u00e9rique \u00e0 \u00e9changer des informations d&#039;identit\u00e9. \u00c0 l&#039;avenir, l&#039;accent sera mis sur les actions qui aident \u00e0 att\u00e9nuer le risque d&#039;utilisation d&#039;actifs virtuels li\u00e9s aux ransomwares.<\/p>\n<p>Les orientations r\u00e9vis\u00e9es sont attendues en octobre 2021.<\/p>\n<h2 id=\"money-laundering-and-environmental-crime\">Blanchiment d&#039;argent et criminalit\u00e9 environnementale<\/h2>\n<p>Les recherches men\u00e9es dans ce domaine par le GAFI, parall\u00e8lement au commerce ill\u00e9gal d&#039;esp\u00e8ces sauvages, ont identifi\u00e9 que les criminels utilisent la fraude commerciale et les soci\u00e9t\u00e9s fictives pour blanchir l&#039;argent obtenu gr\u00e2ce \u00e0 la criminalit\u00e9 environnementale. Les marchandises ill\u00e9gales sont m\u00e9lang\u00e9es \u00e0 des marchandises l\u00e9gales pour les rendre plus difficiles \u00e0 d\u00e9tecter.<\/p>\n<p><a href=\"https:\/\/www.fatf-gafi.org\/publications\/methodsandtrends\/documents\/money-laundering-from-environmental-crime.html\" target=\"_blank\" rel=\"nofollow noopener\">rapport du GAFI<\/a> exige que les autorit\u00e9s de lutte contre le blanchiment d&#039;argent travaillent avec des sp\u00e9cialistes de la criminalit\u00e9 environnementale pour s&#039;attaquer \u00e0 ce probl\u00e8me.<\/p>\n<h2 id=\"ethnically-or-racially-motivated-terrorism-financing\">Financement du terrorisme \u00e0 motivation ethnique ou raciale<\/h2>\n<p>Le GAFI \u00e9tudie comment lutter contre le terrorisme d&#039;extr\u00eame droite (\u00ab\u00a0REG\u00a0\u00bb) tout en sensibilisant davantage \u00e0 un probl\u00e8me complexe.<\/p>\n<p>Ce probl\u00e8me est devenu plus r\u00e9pandu ces derni\u00e8res ann\u00e9es, ayant augment\u00e9 en fr\u00e9quence. Les attaques de cette nature peuvent impliquer des organisations et des mouvements transnationaux. Les personnes impliqu\u00e9es sont de plus en plus sophistiqu\u00e9es dans la fa\u00e7on dont elles d\u00e9placent l&#039;argent. Fait int\u00e9ressant, la majeure partie du financement des restes explosifs de guerre provient de sources l\u00e9gitimes et l\u00e9gales comme les dons.<\/p>\n<p>Le rapport du GAFI finalis\u00e9 en pl\u00e9ni\u00e8re souligne le <a href=\"https:\/\/www.fatf-gafi.org\/publications\/methodsandtrends\/documents\/ethnically-racially-motivated-terrorism-financing.html\" target=\"_blank\" rel=\"nofollow noopener\">d\u00e9fis dans la lutte contre le financement des REG<\/a>, tels que des points de vue divergents sur la fa\u00e7on dont il devrait \u00eatre trait\u00e9 et un manque de ressources d\u00e9sign\u00e9es.<\/p>\n<p>Les pays sont encourag\u00e9s \u00e0 consacrer plus de temps et de fonds pour d\u00e9velopper leur compr\u00e9hension de la question.<\/p>\n<h2 id=\"operational-challenges-of-asset-recovery\"><strong>D\u00e9fis op\u00e9rationnels de la r\u00e9cup\u00e9ration d&#039;actifs<\/strong><\/h2>\n<p>Le recouvrement d&#039;avoirs est l&#039;un des outils les plus efficaces pour lutter contre le blanchiment d&#039;argent et le financement du terrorisme. Non seulement il saisit les produits du crime, mais il indemnise \u00e9galement les victimes, renforce la confiance dans la soci\u00e9t\u00e9 et emp\u00eache l&#039;argent d&#039;entrer dans le syst\u00e8me financier.<\/p>\n<p>Le GAFI a identifi\u00e9 que la plupart des pays sont inefficaces lorsqu&#039;il s&#039;agit de leur capacit\u00e9 \u00e0 recouvrer les actifs avec succ\u00e8s. Il a offert des conseils aux autorit\u00e9s gouvernementales qui cherchent \u00e0 surmonter les principaux obstacles \u00e0 suivre lors de la prochaine r\u00e9union.<\/p>\n<h2 id=\"proliferation-financing-risks\">Risques li\u00e9s au financement de la prolif\u00e9ration<\/h2>\n<p>Le GAFI a mis en place de nouvelles exigences obligatoires. Les pays et les institutions financi\u00e8res doivent identifier, \u00e9valuer, comprendre et att\u00e9nuer le risque de financement de la prolif\u00e9ration.<\/p>\n<p>Le GAFI a \u00e9galement mis \u00e0 jour son <strong>Note interpr\u00e9tative de la recommandation 15<\/strong>. La mise \u00e0 jour fournit des conseils sur la mani\u00e8re dont les PSAV doivent \u00eatre trait\u00e9s par rapport \u00e0 la r\u00e9glementation et \u00e9galement sur la mani\u00e8re dont les institutions financi\u00e8res doivent traiter les PSAV. La mise \u00e0 jour pr\u00e9cise \u00e9galement que les VAP sont \u00e9galement tenus d&#039;effectuer des \u00e9valuations des risques de prolif\u00e9ration de la m\u00eame mani\u00e8re que les institutions financi\u00e8res le font actuellement.<\/p>\n<h2 id=\"transparency-around-beneficial-ownership\">Transparence autour de la propri\u00e9t\u00e9 effective<\/h2>\n<p>\u00c9tablir qui se cache derri\u00e8re les entreprises est essentiel pour emp\u00eacher les criminels de se cacher derri\u00e8re un r\u00e9seau de structures complexes con\u00e7ues pour semer la confusion.<\/p>\n<p>La n\u00e9cessit\u00e9 d&#039;une plus grande transparence autour de la propri\u00e9t\u00e9 r\u00e9elle est quelque chose que le GAFI pr\u00e9conise depuis deux d\u00e9cennies. Malgr\u00e9 cela, les pays ne font pas assez pour s&#039;assurer que les informations sur les b\u00e9n\u00e9ficiaires effectifs sont disponibles.<\/p>\n<p><a href=\"https:\/\/www.g7uk.org\/\">Ministres du G7<\/a> ont reconnu les probl\u00e8mes que cela cause et ont accept\u00e9 de travailler \u00e0 l&#039;am\u00e9lioration de la disponibilit\u00e9 de ces informations. Le GAFI envisage \u00e9galement <a href=\"https:\/\/www.fatf-gafi.org\/publications\/fatfrecommendations\/documents\/white-paper-r24.html\" target=\"_blank\" rel=\"nofollow noopener\">modifiant la recommandation 24<\/a> pour le rendre plus fort et avec des contr\u00f4les plus stricts. Cela devrait \u00eatre \u00e0 nouveau discut\u00e9 en octobre.<\/p>\n<h2 id=\"country-specific-initiatives\">Initiatives sp\u00e9cifiques aux pays<\/h2>\n<p><strong>Afrique du Sud<\/strong><\/p>\n<p>Le GAFI a travaill\u00e9 aux c\u00f4t\u00e9s <a href=\"https:\/\/www.esaamlg.org\/\" target=\"_blank\" rel=\"nofollow noopener\">le Groupe de lutte contre le blanchiment d&#039;argent d&#039;Afrique orientale et australe<\/a> pour lutter contre le blanchiment d&#039;argent et le financement du terrorisme en Afrique du Sud. Bien qu&#039;il existe un cadre juridique solide, l&#039;Afrique du Sud doit faire plus pour poursuivre de mani\u00e8re proactive le blanchiment d&#039;argent et le financement du terrorisme conform\u00e9ment \u00e0 son profil de risque.<\/p>\n<p><strong>Japon<\/strong><\/p>\n<p>Le GAFI a \u00e9galement travaill\u00e9 avec le <a href=\"http:\/\/www.apgml.org\/\" target=\"_blank\" rel=\"nofollow noopener\">Groupe Asie\/Pacifique sur le blanchiment d&#039;argent<\/a> \u00e9valuation des mesures prises par le Japon pour lutter contre le blanchiment d&#039;argent et le financement du terrorisme. Il a constat\u00e9 que les mesures du Japon fonctionnaient et qu&#039;elles donnaient de bons r\u00e9sultats. Cependant, il reste du travail \u00e0 faire dans certains domaines, notamment les enqu\u00eates et les poursuites en mati\u00e8re d&#039;infractions de blanchiment de capitaux et de financement du terrorisme.<\/p>\n<p><strong>Ghana<\/strong><\/p>\n<p>En raison des progr\u00e8s significatifs r\u00e9alis\u00e9s dans la r\u00e9solution des carences en mati\u00e8re de LBC\/FT, le Ghana n&#039;est plus soumis \u00e0 la surveillance accrue du GAFI.<\/p>\n<p><strong>Ha\u00efti, Malte, les Philippines et le Soudan du Sud<\/strong><\/p>\n<p>Ces 4 pays ont tous \u00e9t\u00e9 ajout\u00e9s \u00e0 <a href=\"https:\/\/www.fatf-gafi.org\/publications\/high-risk-and-other-monitored-jurisdictions\/documents\/increased-monitoring-june-2021.html\" target=\"_blank\" rel=\"nofollow noopener\">la liste des juridictions<\/a> soumis \u00e0 une surveillance accrue.<\/p>\n<p>Le GAFI travaille avec un certain nombre de juridictions o\u00f9 leurs r\u00e9gimes de lutte contre le terrorisme, le blanchiment d&#039;argent et le financement de la prolif\u00e9ration ne sont pas efficaces. Ces juridictions sous surveillance accrue se sont engag\u00e9es \u00e0 r\u00e9soudre les probl\u00e8mes identifi\u00e9s dans un d\u00e9lai d\u00e9fini.<\/p>\n<h2 id=\"strengthening-the-global-network\">Renforcement du r\u00e9seau mondial<\/h2>\n<p>Les efforts du GAFI ne sont efficaces que si les garanties sont mises en \u0153uvre dans le monde entier. Par cons\u00e9quent, la pl\u00e9ni\u00e8re a soulign\u00e9 le r\u00f4le de <a href=\"https:\/\/www.fatf-gafi.org\/publications\/fatfgeneral\/documents\/high-levelprinciplesfortherelationshipbetweenthefatfandthefatf-styleregionalbodies.html\" target=\"_blank\" rel=\"nofollow noopener\">Organismes r\u00e9gionaux de style GAFI<\/a> (FSRB) dans la lutte contre le blanchiment d&#039;argent.
