Es bringt zus\u00e4tzliche AML-Regulierungsanforderungen f\u00fcr verpflichtete Unternehmen wie Banken mit sich. Was sind das f\u00fcr \u00c4nderungen? Und welche Ma\u00dfnahmen m\u00fcssen betroffene Unternehmen ergreifen?<\/p>\n<p>Am 3. Dezember 2020, der 6. Auflage der Geldw\u00e4scherichtlinie der Europ\u00e4ischen Union (<a href=\"https:\/\/ec.europa.eu\/finance\/docs\/law\/210720-proposal-amld6_en.pdf\" target=\"_blank\" rel=\"nofollow noopener\">6AMLD<\/a>) in Kraft getreten. Regulierte Unternehmen, die in der EU t\u00e4tig sind, m\u00fcssen bis zum 3. Juni 2021 konform sein. Zu den verpflichteten Unternehmen geh\u00f6ren Banken, Investmenth\u00e4user, Gl\u00fccksspielorganisationen und Finanzdienstleister.<\/p>\n<p>Aufbauend auf der 5. Fassung der Richtlinie hat 6AMLD den Anwendungsbereich der Verpflichtungen und Sanktionen f\u00fcr Unternehmen, die Finanztransaktionen in gro\u00dfem Umfang abwickeln, auf verschiedene Weise erweitert:<\/p>\n<h2 id=\"expanded-cooperation-and-harmonization\">Erweiterte Zusammenarbeit und <strong><strong>Harmonisierung<\/strong><\/strong><\/h2>\n<p>Die Anforderungen wurden in allen L\u00e4ndern des EU-Blocks harmonisiert und erfordern eine grenz\u00fcberschreitende Zusammenarbeit und eine eventuelle strafrechtliche Verfolgung von Straft\u00e4tern innerhalb eines einzigen, gew\u00e4hlten EU-Staates.<\/p>\n<p>Eine erweiterte Liste von 22 Vortaten (Verm\u00f6gen schaffende Straftaten, die durch Geldw\u00e4sche verschleiert werden) wurde vereinbart und umfasst nun erstmals auch Cyberkriminalit\u00e4t.<\/p>\n<p>Die Aufnahme von Cyberkriminalit\u00e4t in die Liste der Vortaten bedeutet, dass Unternehmen, die im FinTech-Umfeld t\u00e4tig sind, ihre Know-Your-Customer- (KYC) und Anti-Geldw\u00e4sche- (AML) Ma\u00dfnahmen aufgrund des erh\u00f6hten Risikos der Nichteinhaltung verst\u00e4rken m\u00fcssen. Nun k\u00f6nnen auch einzelne Entscheidungstr\u00e4ger innerhalb einer Organisation wegen Straftaten wie \u201eAnstiftung\u201c, \u201eAnstiftung\u201c oder \u201eVersuch\u201c zur Geldw\u00e4sche strafrechtlich verfolgt werden.<\/p>\n<p>Dar\u00fcber hinaus werden alle \u201ejuristischen Personen\u201c, einschlie\u00dflich Einzelunternehmer und Personengesellschaften, strafrechtlich daf\u00fcr haftbar gemacht, dass sie illegale Aktivit\u00e4ten auf ihren Plattformen oder in ihrem Unternehmen zulassen.<\/p>\n<p>Diese breitere Definition von Fehlverhalten und die Ausweitung der Haftungsm\u00f6glichkeit setzen Unternehmen ohne geeignete AML\/KYC-Ma\u00dfnahmen einem erheblichen Risiko aus. Durch die Einbeziehung aktueller Sicherheitsma\u00dfnahmen wird sichergestellt, dass die Mitarbeiter nicht versucht sind, sich an diesen illegalen Aktivit\u00e4ten zu beteiligen.<\/p>\n<h2 id=\"enhanced-penalties\">Verst\u00e4rkte Strafen<\/h2>\n<p>Zuvor lag die Mindeststrafe f\u00fcr Geldw\u00e4sche bei einem Jahr Gef\u00e4ngnis. Unter 6AMLD wurde diese deutlich erh\u00f6ht. Eine vierj\u00e4hrige Haftstrafe ist jetzt die Mindeststrafe.
